“How would you handle my case?”
In my opinion, this question is one of the most important questions to ask any prospective attorney. With the proper documentation and charging information, and after getting a chance to talk over your version of events, your potential attorney should be able to give you an informed estimation of how they would approach your case. They ought to be able to discuss possible issues they see with your case, as well as potential advantages. You should have at least a rough idea of how your attorney will proceed with the case, such as what witnesses they will want to speak with, if they would like to go to the scene, and so on.
Of course, a lot of times an attorney won’t be able to anticipate exactly everything they would do. This is because while on a case, a big component of our job is reacting to things. There may be a new development in the case, new evidence might surface, or a new witness might come forward. New charges could come up, or the current charges could somehow change. While those are all things that no attorney will be able to predict, they should at least be able to provide you with enough information for you to make an informed decision. Consider how you feel about this attorney’s approach, if you agree with their philosophy, and whether you think this attorney is a good fit.
